POSITION SUMMARY


The County Solicitor is responsible for the day-to-day legal needs of County government operations, including the Commissioners, all County departments, boards, authorities, and the York County Prison. Responsibilities include, but are not limited to, rendering legal advice, providing representation before state and federal courts, as well as governmental agencies, drafting and negotiating legal documents, instruments, and ordinances, and developing and implementing policies and procedures. 

The Solicitor is also the Open Records Officer for the County and is, therefore, responsible for receiving and responding to all Right to Know requests directed to the County with the exception of the District Attorney’s Office and the Court of Common Pleas.

ESSENTIAL REQUIREMENTS

 
  • Must possess a law degree and a minimum of ten (10) years legal experience.
  • Preferable that Solicitor has civil litigation, municipal law, and employment law background.
  • Must be an effective communicator, both orally and written.
  • Must possess the ability to deal tactfully with department personnel, government agencies/personnel, clients, and the public.
  • Must possess the ability and willingness to work harmoniously with professionals and non-professionals.
  • Must have patience, tact, and a professional manner when conducting business.
  • Must be available to attend meetings and conferences as directed.
  • Other reasonable duties as assigned by Commissioners.

ESSENTIAL DUTIES AND RESPONSIBILITIES

 
  • Represent the County and its employees in federal and state litigation, as well before governmental agencies, in additional to delegating, managing, and coordinating outside counsel representing the County and its employees in various matters.
  • Provide legal support and advice to the County Commissioners, all County departments, York County Prison Board of Inspectors, York County Salary Board, York County Board of Elections, various County authorities, and the York County Planning Commission.
  • Lead and manage intra-County department groups to address issues, develop strategies, and create and implement policies and practices to improve the efficiency and effectiveness of County government.
  • Draft, negotiate and review contracts, agreements, and memorandum of understandings, as well as other legal documents.
  • Draft and review resolutions, policies, and ordinances.
  • Receive and review all Right to Know requests, compile and review responsive records, redact and revise when necessary, issue responses to requestors, and represent the County in any ensuing appeals and litigation.
  • Receive and process all IFP petitions, as well as represent the County before the Court of Common Pleas regarding the appropriateness of such relief.
  • Process and litigate collection matters for all County departments.
  • Maintain and update County Code and code books.
  • Prepare and present annual budget for Solicitor’s Office.
  • Prepare and file Petition for Special Counsel at the beginning of the calendar year.
  • Attend Commissioners’ meetings, as well as various board meetings.
  • Provide a weekly Solicitor’s report to Commissioners prior to Commissioner’s Meeting.
  • Participate in Continuity of Government (COG).
  • Supervise Solicitor’s office staff.
