2010 CCAP Legislative Priorities

MEDIA RELEASE SCHEDULED FOR JANUARY 13, 2010   

CCAP will unveil their 2010 Legislative Priorities on January 13, 2010, at 1:00 p.m., in the Capitol Rotunda. All CCAP Officers are invited to attend. 

In conjunction with this unveiling, CCAP's Board of Directors will be in Harrisburg on February 8, 2010, for legislative leadership visits to discuss these priorities and to attend a luncheon with former county officials in the House and Senate.

DCED Report On Earned Income Tax Online

PROVIDES GUIDANCE ON CONSOLIDATION  

The Department of Community and Economic Development (DCED) has compiled a report evaluating the most cost-effective and efficient way to consolidate the Earned Income Tax (EIT) system. The report also includes helpful templates, forms, sample letters and requests for proposals. 

Municipalities and school districts can utilize the report to assist in consolidation, which is slated to be completed in January 2012. The report, titled "Earned Income Tax Consolidation Best Practices Report," is available online, keyword: "best practices."

Decision Released In Jefferson County Case 

PA SUPREME COURT RULES IN FAVOR OF JUDICIARY   

On December 28, 2009, the Pennsylvania Supreme Court issued a decision in Jefferson County Court Appointed Employees Association v. Pennsylvania Labor Relations Board, 37 WAP 2007 (Pa. December 28, 2009).  In sum, the Court overturned the Commonwealth Court's decision that the County's elimination of trial court employee positions and subsequent failure to institute grievance settlements approved by the President Judge was within the County's budget setting authority. Instead, the Pennsylvania Supremem Court found that the elimination of five trial court employees by Jefferson County's Salary Board interfered with the judiciary's constitutional right to hire, fire, and supervise employees.   

The Pennsylvania Labor Relations Board (PLRB) previously ruled in favor of the County, finding that implementing the grievance settlements would infringe on the County's Constitutionally protected budgetary function. The PLRB also held that the Association lacked standing to litigate the matter, finding that the judiciary's proper remedy would have been to file a mandamus against the County. The Commonwealth Court affirmed the PLRB's decision. 

The Pennsylvania Supreme Court disagreed, finding instead that while the County, through its Commissioners, has every right to decrease budget appropriations to the judiciary, it is the judiciary's right to determine how best to allocate those funds. The Court held that by not implementing the grievance settlements, the County committed an unfair labor practice. The Court further noted that if the judiciary had disagreed with budget appropriations, they could have filed a mandamus; but, since the Association was actually disputing the failure of the County to implement grievance settlements, they had proper standing to litigate the matter. 2010 NACo Achievement Awards 

APPLICATION DEADLINE FEBRUARY 12, 2010  

The NACo Achievement Awards Program is a non-competitive program recognizing innovative county government programs in various program categories such as arts and historic preservation, children and youth, community and economic development, jails-corrections, county administration, emergency management, environmental protection, health, human services, libraries, parks and recreation, transportation and volunteers. 

There is a new application process this year requiring part of the application to be completed online. The program narrative and any supplemental materials must still be mailed along with an email confirmation page. Applications and materials must be postmarked by February 12, 2010.

New ARRA Reporting Guidance

DEADLINE IS JANUARY 15, 2010  

The next mandatory Recovery Act reports, covering the October 1, 2009 - December 31, 2009 reporting period, are due January 10, 2010. However, a grace period has been added to allow for the submission of reports up through January 15, 2010. All Recovery Act recipients that have received notices of awards by December 31, 2009 are required to submit reports in addition to the reports required by the individual federal agencies disbursing the funds. Please go to the Federal Reporting Website for more information or to register.  

In addition, the Federal Office of Management and Budget (OMB) released new guidance on job reporting and data quality that must be followed. The major changes include a switch from cumulative reporting to quarterly reporting and a simplification of the definition of a job created or retained by Recovery Act funds. This new guidance does not create the need to revise job data submitted for the first reporting period. Click here for the new guidance provided on the OMB website. DOC Names Replacement

KEEN NAMED AS DIRECTOR OF COUNTY INSPECTIONS    

Pennsylvania Department of Corrections (DOC) Executive Deputy Secretary William D. Sprenkle has announced that Daniel Keen will serve as the new Director of the Office of County Inspections and Services. Keen will begin this position in January following former Director Ed Pfister's retirement.   

Keen currently serves as Warden of the Bedford County Jail and has considerable experience in County Jail operations including service as a Corrections Officer in Clinton County, a Corporal in Montgomery County, Maryland, and a Lieutenant in Clinton County.

DCED And PennDOT Annual Reporting Forms

FORMS SHOULD BE FILED BY MARCH 1, 2010    

Counties have received a packet of various forms, instructions, and informational materials as part of the joint mailing by the Department of Community and Economic Development (DCED) and the Department of Transportation (PennDOT). The joint mailing is a cooperative effort on the part of state government to collect annual reporting information from counties and municipalities. All of the PennDOT Municipal Services' 2009 forms and year-end reports are available through the PennDOT Web site  

These forms have various due dates, which were outlined in the packet.  However, to ensure that State Liquid Fuels payments are received on time, the DCED Municipality Report of Elected and Appointed Officials due January 31, 2010, the DCED Survey of Financial Condition due March 15, 2010, and the PennDOT Annual Year End Report should be filed no later than March 1, 2010.

Floodplain Management Activities Report

ANNUAL REPORT DEADLINE FEBRUARY 28, 2010  

All flood prone municipalities are required to file an annual report with the Department of Community and Economic Development (DCED) detailing all development permits issued within each municipality. Filing a completed report prior to February 28, 2010 is necessary regardless of whether any permits were issued.  

DCED is also authorized to reimburse municipalities for up to 50 percent of the costs incurred in the preparation, enactment, administration, and enforcement of the required floodplain management ordinances. Any municipality seeking a reimbursement must complete a Floodplain Management Reimbursement Application by February 28, 2010.
